Colorado Revised Statutes § 18-12-107.5 - Illegal Discharge of a Firearm

  • Any person who knowingly or recklessly discharges a firearm into any dwelling or any other building or occupied structure, or into any motor vehicle occupied by any person, commits the offense of illegal discharge of a firearm.
  • It shall not be an offense under this section if the person who discharges a firearm in violation of subsection (1) of this section is a peace officer as described in section 16-2.5-101, C.R.S., acting within the scope of such officer's authority and in the performance of such officer's duties.
  • Illegal discharge of a firearm is a class 5 felony.

A class 5 felony carries a presumptive 1-3 year prison sentence that can be aggravated up to 6 years, followed by a 2 year period of parole. This charge is probation eligible. If convicted of a felony, your gun rights are forever revoked, meaning you are never again allowed to own, possess, hold or otherwise control any firearm or gun.

If you have discharged a firearm and you are concerned the police may contact you, please call us. No matter the facts, it is best for you to tell the police that you do not wish to make any statements without a lawyer present. You do not know what evidence is missing or what they know. We will find the best way to respond together. Just say, I want a lawyer.

You do not need to consent to a search. If you do not know if police are asking for consent to search, you can say, “do I have to?” and “I am not consenting to any search.” The police will likely conduct the search anyway. Do not argue and do not get in their way. The time to argue about police conduct is in court with a lawyer.

Prior experiences include a man showing his girlfriend how to load a shotgun so she could protect herself. Unfortunately, the gun went off, with the projectile entering the next apartment owned by a deputy sheriff. The man had been drinking alcohol making this case very difficult.

In another case, a man thought a person was breaking in and his gun went off only going through an interior wall of his own apartment. Early investigation and discussion with the charging prosecutor prevented this felony from being charged.
