- Speculated or wagered on the basis of such information or official action
A person can be charged with misuse of official information (CRS 18-8-402(1)(b)) when the government alleges they were:
- A public servant, and
- In contemplation of official action by themselves or by a governmental unit with which they were associated or in reliance on information to which they had access in their official capacity and which had not been made public,
- With intent
- To confer on any person a special pecuniary benefit,
- Aided, advised, or encouraged another to acquire a pecuniary interest in any property, transaction, or enterprise which might be affected by such information or official action or aided, advised, or encouraged another to speculate or wager on the basis
